Found this interesting article on boundary disputes recently in the Weekend magazine of the Guardian. This may clear a few things up.

    If someone wishes to build on or alter land which may affect you negatively, you may wish to support your argument with legal documents that clearly state boundary ownership and rights of way. Similarly, if you wish to build on land and someone else is objecting, you may also be able to win your argument when producing these documents.     They helped me when I wanted to stop someone building a very high fence between our properties – it turned out that I actually owned the land.
